These services are available for both residential and commercial clients.
2. Client Responsibilities
• Accurate Information: You agree to provide accurate and complete information regarding your moving and logistics needs, including but not limited to the details of the items to be moved, delivery addresses, and any special requirements.
• Access: You must ensure that access to the property, including doorways, hallways, and elevators, is available and adequate for moving large or heavy items.
• Preparation: Clients are responsible for properly packing and securing fragile or valuable items, unless explicitly included in the service package.
• Liability for Items: KCM Luxe Interiors is not liable for any damage to items that were not properly packed or that were inaccessible due to issues such as limited space, lack of access, or unsafe conditions.
3. Pricing and Payment
• Quoted Pricing: All prices provided are estimates based on the information available at the time of the quote. Prices are subject to change based on changes to the scope of work or unforeseen circumstances.
• Payment Terms: Payments are due according to the agreed-upon terms. Any outstanding balances may result in delays in services or cancellation of the service.
• Refunds and Cancellations:
• Cancellation Policy: Clients must notify KCM Luxe Interiors at least 48 hours in advance for a full refund. Any cancellations within 48 hours may incur a fee.
• Refunds: Refunds are only issued if services are not performed as agreed, subject to a thorough investigation and determination by KCM Luxe Interiors.
4. Liability and Insurance
• Liability for Damaged Goods: KCM Luxe Interiors will not be held liable for any damage to goods or property, unless caused by negligence or fault on our part. Damages should be reported immediately upon delivery or completion of services.
• Insurance: We recommend that clients acquire appropriate insurance coverage for valuable or fragile items. KCM Luxe Interiors offers limited liability for damaged or lost goods under specific conditions as outlined in the service agreement.
• Exclusions: KCM Luxe Interiors is not responsible for damage to items not provided by us, including items left unprotected or inaccessible, or for damages occurring due to external factors (e.g., weather conditions, accidents, etc.).
5. Limitation of Liability
To the fullest extent permitted by law, KCM Luxe Interiors' liability is limited to the value of the services provided and excludes any consequential, incidental, or indirect damages, including lost profits or personal injury.
6. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any disputes arising out of these terms will be resolved in the courts of New York, NY.
7. Modifications
KCM Luxe Interiors reserves the right to update or modify these Terms of Service at any time. Changes will be posted on our website, and your continued use of our services constitutes acceptance of the updated terms.
